. walmart. >>> welcome back. we're following a developing story regarding toyota. transportation department official says toyota will now recall the 2010 lexus gx 460 to address a potential problem with the suv rolling over. you might recall last week "consumer reports" issued a don't buy warning for this vehicle saying that it was susceptible to rolling over. toyota suspended sales of the suv and now it is recalling some 6,000 vehicles sold since the suv went on sale for retail around $50,000. another blow here for toyota to report to you this afternoon. >>> and senate democratic aide now says the senate will take up financial regulatory reform thursday. that is the same day president obama comes here to new york to push for reform. republicans opposed to the measure are threatening to block the senate from taking action. nbc's kelly o'donnell joins us from capitol hill. so you've got scott brown, the new senator from massachusetts, saying he will -- it seems the democrats and the president have this all hands on deck strategy. they really want to get something done and think they've got m
toyota. a record $16.4 million penalty for the automaker's alleged failure to quickly tell regulators about gad pedal problems. phil lebeau covers the car industry for us. seems like regulators are sending a message to toyota with this fine they are looking to pursue. >> yeah, this is the way the federal government is saying to toyota, you know what? we're not happy with the way this thing played out over last six months, specifically the handling of the recall notices and the sfiky gad psticky gad p. in fact, documents show they knew about it on september 29th but there wasn't a recall in the united states until january 21st. federal law says you must notify the national highway traffic safety administration within five days of knowledge of a defect. toyota went several months before announcing the defect. remember, february 1st is when they said this is the fix for these sticky gas pd edals. $16.4 million, that's the fine. the largest possible fine that they can put against toyota and that's what it is coming from nhtsa to toyota in the case of this recall issue. >> phil lebeau, tha
gx 460 suv. toyota suspended sales of the lexus suv last night after consumer reports announced its tests indicated the vehicles are a rollover risk and advised people flat out not to buy them. nbc's jeff rossen joins us from chicago. so, jeff, what's the latest on the federal safety officials getting involved and what is toyota saying now? >> reporter: right. toyota is now saying they're just trying to identify and analyze the problem. toyota was shell shocked i think as consumers were, we all were by this. "consumer reports" incredibly rare that they would come out with a do not buy warning for consumers. often they say this car is better than that car but to flat out say don't buy this car because it's dangerous is something in a new league. the last time they did it was 2001. toyota of course, tamron, under incredible pressure with the gas pedal controversy and critics who say they didn't respond fast enough to that. within hours of "consumer reports" coming out with this warning to consumers, they, themselves, put a stop sales order to their dealerships nationwide. you can't go
by toyota. we've got more it, though. >>> it's been more than a month since former new york congressman eric massa resigned from office and left washington. today we are getting new details about just how bad things reportedly got for his staffers in his office. "the washington post" reports that massa's aides repeatedly complained to senior staff, alleging that massa touched them in a sexual manner or made sexual overtures, including expressing desire to have sex with one of the men in the office. this as the house continues to investigate the allegations against the former congressman. nbc's luke russert is on capitol hill. luke, why are we learning such specific and quite honestly to some, disturbing, allegations now? >> reporter: well, tamron, it's quite interesting. what a lot of members said to me who are close to the situation about a month ago, is once you get some real investigative reporting into eric massa, you're going to have a real big problem. all sorts of allegations are going to come out. that is, in fact, what happened today with the amazing report from the "washington post
is over. we need to come clean. that's what herb miller, toyota's then group vice president told his colleagues in an e-mail referring to the safety problems just five days before toyota announced the recall. phil lebeau joins us now. what's toyota's response? >> they are not specifically commenting about the e-mail, but they say they understand they've done a poor job of communicating. this is a copy of it. one of 70,000 document that is the federal government has been going over in looking at how toyota handled the recall for sticky gas pedals. it's clear that some toyota executives realized they had to come out and say something. although it was sent five days before the recall. one of the quotes in this -- then saying they need to work out a resolution with the national highway safety administration. as interesting as the wording is here, lawyers who have sued the company and are planning on taking the company to court, almost all say the same thing. which is great for the public fodder. not sure how much this is going to help their cases in course aside from the fact it's one mo
to a local hospital for treatment. her parents say she's doing wonderfully. >>> toyota is halting sales of lexus gx 460 suv after consumer reports warned people not to buy it. the magazine says the vehicle is a rollover risk. it's rare for the magazine to make such a warning. joining me, senior editors for cars.com. we were talking about this warning from consumer report yesterday. a few hours later toyota makes this big statement that they are not -- they are suspending the sale of this vehicle. what do you make of this response and what's going on here? >> i think toyota has definitely learned from their past mistakes about not acting fast enough. when they heard this news, they within 24 hours of consumer reports coming out with this don't buy recommendation, they went ahead and suspended sales. not only that, they are giving loaner cars to the 6,000 people that own one until a fix is developed. >> nhtsa, the agency that oversee safety with six and such, this car was approved and okay under their eyesight, an independent agency, consumer reports, does this and now you can't purchase

automaker toyota. now dealerships will stop selling the 2010 lexus gx 460 until problems with handling can be worked out. just the latest in a series of safety problems here. nbc's jeff rossen is in chicago now. all right. i guess here we go again, jeff. >> yeah. here we go with toyota once again. lexus, their luxury brand. the gx 460. consumer reports yesterday came out with that do not buy order. something they very rarely do. actually telling consumers don't buy this vehicle because it can turn over. within hours of that, toyota didn't deny there was a problem. instead they came out and said, you know what? they told all of their dealers, stop selling them. we want to identify and fix this problem. and so right now, i mean, i'm looking at the numbers here. 6,000 of these suvs were sold so far. another 1,600 are sitting at dealerships. which means that toyota will stop collecting this money that they had hoped to get from this while they try to figure out what this problem is. they're also saying that if you were one of the people that bought these 6,000 lexuses gx 460s, you can bring th
it intends to bring them to trial. >>> automaker toyota is in damage control mode yet again. it comes after an internal toyota e-mail surfaced raising new questions about whether toyota hid safety problems. cnbc's phil lebeau covers the auto industry for us. what else was in this memo or e-mail? >> reporter: it's short e-mail. we have a copy here. the most damaging language from irv miller who retired from the company shortly after the recall notices went out, but the most damaging comments, essentially, he says, we can no longer hide what's going on here. we need to come clean about the fact that there is a problem with our gas pedals. they are defective and they want to work out a solution with nhtsa, the national highway traffic safety administration. more than anything what this e-mail does is it undercuts the message that toyota has been putting out to the american public since early january which is, we understand that there are concerns about what's happening with our vehicles. we are moving as quickly as possible to address the situation. tamron, this e-mail was sent on january 16th

's causing all of this? >> it really is if you're ready to buy a car, do it the right way. we know toyota in the past didn't have to offer incentives. they had the best-selling model car eight of the past ten years. people were buying toyotas even without the incentives. but because of course all the recalls, the bad publicity, sales dipped tremendously low and they were forced to offer incentives and they're pretty big, on average over $2,200 per war. they have taken their market share up 41%. they almost doubled their sales in march from february. and these incentives are totally fueling this. now, the other automakers are seeing this. they're losing some market share. they know they have to keep up. it's like if you have a gas station a half-mile down the road and you own the other gas station, if he cults his price by ten cents, you have to follow. it's really kind of -- it drags actually the whole industry down in terms of incentives. there's a lot of peer pressure here and fighting for everyone's dollars. >> do you have some examples of what different carmakers are offering? >> this
